Netherlands Clarifies 8-Month Rule for Families of Skilled Migrants

by awbtravelsnews | May 29, 2026

Families of highly skilled foreign workers in the Netherlands just got a little more breathing room. The Dutch Immigration and Naturalisation Service, also known as Immigration and Naturalisation Service, has now confirmed that dependent family members of Highly Skilled Migrant permit holders can stay outside the Netherlands for up to eight months if the main permit holder is abroad for work.

That clarification matters because the agency’s website previously only mentioned the right for the main visa holder. Spouses and children were left in a grey area.

For Indian professionals working in tech, engineering, finance, and research roles across cities like Amsterdam, Eindhoven, and Rotterdam, this removes a common headache. Many expats split time between Europe and India due to projects, family responsibilities, or long work assignments abroad.

What This Means for Families

Under Dutch residency rules, staying outside the Netherlands for too long can affect residence rights and future permanent residency applications.

The updated clarification now confirms that accompanying family members will not automatically run into trouble if:

This is especially relevant for Indian IT professionals employed by multinational firms that rotate staff between Europe, the Gulf, Singapore, and India.

Why This Update Matters

The Netherlands has quietly become one of Europe’s more practical destinations for skilled Indian workers. English-speaking workplaces, fast public transport, and comparatively quicker residence processing continue to attract talent away from traditional options like the UK.

What we’re seeing across Europe is a softer shift toward flexibility for global workers. Governments still want tax-paying talent, but they now understand that international professionals rarely stay tied to one country year-round.

A Few Important Conditions Still Apply

The clarification does not remove all residency obligations. Permit holders and their families should still:

Indian nationals planning long stays outside the Netherlands should also remember that EU long-term residence rules can differ from temporary permit conditions.

Take

We think this is a practical fix. Foreign professionals working across multiple countries now have clearer rules, fewer residency worries, and more flexibility to manage work and family without unnecessary immigration confusion.
