Mexico Updates Work And Temporary Residence Visa Rules for Foreign Workers

by awbtravelsnews | May 21, 2026

Mexico has introduced stricter visa rules for foreigners applying for residence and work visas, including the Temporary Residence Visa for paid employment. The new rules are already in effect across the country.

The changes bring tougher documentation and compliance requirements for both employers and foreign workers, with authorities now asking for more detailed job and qualification information during the visa process.

Expanded Offer Letter Requirements

The biggest update is related to job offer letters. Employers must now provide more details when sponsoring foreign workers. Offer letters must clearly mention:

It is important to note here that, earlier, companies usually included only basic information such as the job title, salary, and work location.

Because the rules started immediately, many companies may need more time to update their existing documents before filing applications. This could also slow down processing times while HR and immigration teams adjust to the new system.

More Checks on Qualifications

Mexican immigration authorities can now ask applicants to submit proof of qualifications, such as:

This may even apply to senior executives and managers, who previously faced fewer checks.

Experts expect more document requests and possible delays, especially for highly skilled or technical roles. Employers are also being advised to clearly explain whether a role is managerial or highly technical in visa paperwork.

New Rules for Strategic Projects

For jobs linked to “strategic projects” or highly specialised work, companies may also need to include training or knowledge-transfer plans for Mexican workers in the offer letter.

While Mexican law has mentioned this before, it was rarely enforced in practice. Authorities are expected to release more guidance on what qualifies as a strategic project.

Why Mexico Is Making These Changes

The Mexican government says the reforms are part of its 2025–2030 development plan. The goal is to improve immigration management, support skill development in Mexico, and reduce long-term dependence on foreign expertise.
